Terms of Service

These Terms govern your access to and use of Laventur, including our websites, mobile apps, APIs, public pages, photo import tools, travel maps, lists, discovery features, and related services.

1. Agreement

By creating an account, accessing Laventur, importing photos, publishing a map, saving a link, creating a list, or otherwise using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Laventur.

You must be at least 18 years old, or the age of majority where you live, to use Laventur. You may not use Laventur if you are barred from doing so under applicable law.

2. Accounts

You are responsible for your account, credentials, devices, and all activity under your account. Keep your login information secure and tell us promptly if you believe your account has been compromised.

You agree to provide accurate account information and to keep it current. We may refuse, reclaim, or change usernames, profile information, or other identifiers that violate these Terms, infringe rights, impersonate others, or create operational or legal risk.

3. User Content

"User Content" means anything you submit, upload, publish, import, link, save, or otherwise provide through Laventur, including photos, thumbnails, map locations, EXIF-derived data, reviews, notes, lists, profiles, avatars, saved links, comments, tags, and related metadata.

You keep ownership of your User Content. You grant Laventur a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, distribute, modify, reformat, create derivative works from, and otherwise use your User Content to operate, provide, secure, moderate, improve, analyze, market, and promote Laventur. This license includes the right to display public User Content in feeds, profiles, search, public maps, shared lists, previews, emails, social previews, and promotional materials.

For private or limited-visibility content, we will use reasonable efforts to respect your selected visibility settings, but you are responsible for what you publish, share, or make available through links. People with access to your content may copy, screenshot, save, or redistribute it outside Laventur.

You represent and warrant that you have all rights, permissions, consents, and authority needed for your User Content and for the rights you grant to Laventur. This includes rights in photos, copyright, trademarks, privacy, publicity, likenesses, people shown in photos, location information, and any third-party material.

4. Photos, Maps, and Location Data

Laventur may let you scan your photo library for location and date metadata, create thumbnails, reverse geocode coordinates, generate visited-place entries, and publish a travel map. You choose whether to connect photos and whether to publish selected locations and thumbnails.

Travel maps, places, dates, photos, and related location data can reveal sensitive information about where you live, travel, worship, work, receive care, or spend time. Do not upload or publish content if you do not have the right to share it or if sharing it would put you or someone else at risk.

Laventur is a travel logging and discovery tool. It is not a safety, emergency, navigation, visa, legal, medical, financial, insurance, or professional advice service. You are responsible for travel decisions, local conditions, laws, restrictions, safety, bookings, costs, and third-party services.

5. Copyright and Other Rights

You may not upload, import, link, copy, display, or distribute content that infringes copyrights, trademarks, privacy rights, publicity rights, contractual rights, or other rights. Laventur may remove content, restrict accounts, terminate repeat infringers, and cooperate with rights holders or authorities where appropriate.

To send a copyright notice, email legal@laventur.com with: your contact information, identification of the copyrighted work, identification of the allegedly infringing material and its location, a good-faith statement, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your physical or electronic signature. Counter-notices should include the information required by the DMCA.

Publishing DMCA contact information here is not enough by itself to preserve all DMCA safe-harbor defenses. Laventur should also maintain a current designated agent registration with the U.S. Copyright Office if it hosts user-generated content.

6. Prohibited Conduct

  • Use Laventur for illegal, deceptive, abusive, harassing, exploitative, discriminatory, or harmful purposes.
  • Upload or share content that is infringing, non-consensual, private, confidential, defamatory, sexually exploitative, or unsafe.
  • Publish another person's precise location, private travel, home, workplace, sensitive site visits, image, or likeness without appropriate permission.
  • Scrape, crawl, harvest, index, train on, resell, broker, arbitrage, or commercially exploit Laventur data, maps, lists, profiles, photos, or recommendations without written permission.
  • Use bots, automation, fake accounts, account sharing, spam, phishing, credential stuffing, or attempts to bypass rate limits, authentication, visibility settings, or security controls.
  • Reverse engineer, interfere with, disrupt, overload, benchmark, copy, or create a competing service using Laventur or its data except where law clearly allows it.
  • Misrepresent travel experiences, reviews, identities, affiliations, endorsements, paid relationships, AI-generated content, or the origin of content.
  • Use Laventur or any AI-assisted feature to generate or distribute illegal, infringing, deceptive, impersonating, unsafe, or rights-violating content.

7. AI and Automated Features

Laventur may use automated systems, machine learning, or AI-assisted tools to operate, protect, moderate, organize, summarize, suggest, translate, rank, recommend, or improve the service. AI-assisted output may be inaccurate, incomplete, offensive, duplicative, unsafe, or not legally protectable. You are responsible for reviewing output before relying on it or publishing it.

Unless we say otherwise in the feature or Privacy Policy, Laventur does not grant third-party AI model providers the right to train their foundation models on your private User Content. We may use aggregated, de-identified, or otherwise non-personal information to improve Laventur.

8. Third-Party Services

Laventur relies on third-party services such as hosting, storage, maps, geocoding, analytics, error monitoring, email, app stores, social login providers, and link-preview providers. Third-party content, websites, APIs, embedded media, map data, travel listings, and linked services are not controlled by Laventur. We are not responsible for their availability, accuracy, policies, prices, safety, or content.

9. Fees and Changes

Laventur may offer free, paid, trial, beta, or promotional features. We may add, modify, suspend, discontinue, limit, or charge for features at any time. If paid features are introduced, any payment, renewal, cancellation, and refund terms shown at purchase will also apply.

10. Moderation and Termination

We may review, remove, restrict, preserve, disclose, suspend, or terminate content or accounts if we believe it is reasonably necessary to operate Laventur, enforce these Terms, protect users, respond to legal process, reduce legal or security risk, or prevent misuse. We do not promise to monitor all content.

You may stop using Laventur at any time. Some content may remain available after deletion if it was shared publicly, cached, copied, backed up, included in another user's content, or retained for legal, security, compliance, or legitimate business purposes.

11. Disclaimers

Laventur is provided "as is" and "as available." To the fullest extent permitted by law, Laventur disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.

We do not endorse, verify, or guarantee User Content, travel recommendations, third-party content, AI-assisted output, map data, places, ratings, links, photos, or any user's identity, experience, opinion, or safety.

12. Limitation of Liability

To the fullest extent permitted by law, Laventur and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, use, content, travel costs, bookings, opportunities, or business, even if we were advised of the possibility of those damages.

To the fullest extent permitted by law, Laventur's total liability for any claim will not exceed the greater of USD $100 or the amount you paid Laventur for the service giving rise to the claim in the 12 months before the claim arose.

13. Indemnity

You will defend, indemnify, and hold harmless Laventur and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of Laventur, your User Content, your violation of these Terms, your violation of law, or your violation of another person's rights.

14. Disputes, Arbitration, and Class Waiver

Please email legal@laventur.com before filing a claim so we can try to resolve the dispute informally. If we cannot resolve it within 60 days, any dispute arising from or relating to Laventur or these Terms will be resolved by binding individual arbitration under the Federal Arbitration Act and the AAA Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court or seek injunctive relief for misuse, security issues, or intellectual property infringement.

You and Laventur waive the right to a jury trial and agree that disputes must be brought only on an individual basis, not as a class, collective, consolidated, private attorney general, or representative action. If a court or arbitrator finds this class waiver invalid, the arbitration agreement will not apply to that claim.

To opt out of arbitration, email legal@laventur.com within 30 days after you first accept these Terms and include your name, account email, and a clear statement that you opt out of arbitration. These Terms are governed by the laws of the State of Texas, excluding conflict of law rules, except to the extent the Federal Arbitration Act governs arbitration.

15. Updates

We may update these Terms from time to time. If changes are material, we will provide notice by reasonable means, such as posting the updated Terms, updating the effective date, or contacting you. Your continued use of Laventur after updated Terms take effect means you accept them.
